1. What The Fightback App Is (And Is Not)

The Fightback App is a document automation and consumer advocacy SaaS platform. We help consumers document service disputes, generate demand letter templates, and connect qualifying cases to plaintiff attorneys. The Fightback App operates under the same model as TurboTax — we generate documents from your inputs without being a law firm, just as TurboTax generates tax returns without being an accounting firm.

2. Eligibility and Account Registration

You must be at least 18 years old and a resident of the United States to use The Fightback App. By creating an account, you represent that all information you provide is accurate and that the dispute you are documenting is your own personal dispute. You may not use The Fightback App to document disputes on behalf of others, as this may constitute unauthorized practice of law.

You are responsible for maintaining the security of your account credentials. The Fightback App is not liable for any unauthorized access to your account resulting from your failure to keep credentials secure.

3. Credit System and Payments

The Fightback App operates on a credit-based system. Credits are purchased through Stripe and used to generate documents and take actions within the platform.

• Credits never expire. Purchased credits remain in your account indefinitely.
• Used credits are non-refundable. Once credits are consumed to generate a document or take an action, they cannot be refunded.
• Unused credits are refundable within 30 days of purchase. Contact support@thefightbackapp.com.
• All purchases are processed by Stripe. The Fightback App does not store your payment card information.
• Subscriptions auto-renew monthly or annually until cancelled.
• We process payments under MCC 7372 (Computer Programming/Data Processing).

4. AI-Generated Documents

Documents generated by The Fightback App are created by artificial intelligence based on information you provide. These documents:

• Are informational templates only — not legal advice
• May contain errors and should be reviewed before use
• Are labeled as AI-generated per applicable state law (including California AB 853)
• Should be reviewed by a licensed attorney before filing in any legal proceeding
• Do not guarantee any legal outcome

5. Attorney Referral Program

The Fightback App may connect qualifying cases with plaintiff attorneys. This connection service is subject to the following:

• Your explicit written consent is required before any case information is shared with any attorney or law firm
• The Fightback App receives a marketing services fee paid from the attorney's fee share — never from your recovery
• The Fightback App does not guarantee that any attorney will accept your case
• Any attorney engagement is solely between you and the attorney — not The Fightback App
• Attorney fees, if any, are governed by your agreement with the attorney, not The Fightback App

6. Prohibited Use

You may not use The Fightback App to:

• File false or fraudulent disputes
• Harass, defame, or threaten any individual or business
• Document disputes on behalf of others without their knowledge
• Violate any applicable federal, state, or local law
• Attempt to reverse-engineer or scrape the platform

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, The Fightback App'S LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR USE OF THE PLATFORM IS LIMITED TO THE AMOUNT YOU PAID TO The Fightback App IN THE 12 MONTHS PRECEDING THE CLAIM. The Fightback App IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. The Fightback App makes no warranty that documents generated will achieve any particular legal outcome.

8. Governing Law

These Terms are governed by the laws of the State of New Jersey. Any disputes shall be resolved in the courts of New Jersey, unless you elect binding arbitration under AAA rules.
